Welcome to the Law Captain's website. Ed Russell served as an U.S. Air Force Captain and when he was honorably discharged from service, then went to law school to continue serving his community. As with any legal issue, the first thing to be aware of is the statute of limitations for your case. Most clients will not have enough time to make a successful claim if given less than four months. Personal Injury

Texas Attorney, Edward Russell, is also licensed to practice in Federal Court (Western District of Texas) and is experienced in auto accidents involving both personal and commercial insurance. I can help you settle or go to court if you are involved in Pedestrian, Auto, and Company vehicle accidents occurring in Texas. I have also helped clients pursue settlements involving Premises liability, and Workplace injuries.

Intellectual Property

Patent litigation is the reason Edward Russell became an attorney. In Hawaii, circa 2012, Ed met Henk Rogers, Founder of Blue Planet Foundation. Henk's story inspired within Ed a deep fascination of Intellectual Property rights. Ed has also succesfully dealt with the USPTO regarding Trademark disputes. Many firms charge an upfront fee and then continue to charge for each correspondence with the USPTO before you ever receive your mark. Based on the complexity of your mark, I know how often you will need my services and will bid accordingly.

Mediation

Edward Russell is certified in civil suit and family law mediation. He received these certifications from the prestigious mediation team at St. Mary's Law, in San Antonio Texas. Civil Settlements

At Edward Russell Law, I prioritize the client's interests. Obtaining the best client outcome may mean going to trial, but it more often involves the ability to evaluate the value of a case and obtain a civil settlement, without the additional costs of trial.

Common Legal Issues Q&A

Time is short. In Texas, you have 2 years to sue the person responsible for your injuries. If you need to file suit immediately, do not hesitate to contact me. If you are in a car accident, the insurance will stall as long as possible in order to eliminate your option to sue their insured. If you were involved in an accident in the last 20 months, you should contact an attorney as soon as possible to determine what your best strategy, given the limited time available. Making a successful claim takes collaboration and evidence.

A lien is a financial interest upon any settlement that you may receive from a liable insurance company. If the hospital hasn’t filed a lien yet, you may be able to negotiate your bill down. However most hospitals file a lien as soon as they realize you were involved in a car accident. Worse, some hospitals still do this even if you had medical insurance at the time. This does not apply to your own auto insurance if you must file an Uninsured Motorist claim or Under-Insured motorist claim. The short answer is probably not. Your insurance will do a risk assessment, however if you were not at fault for the auto accident, then your rates should not go up. Even if your rates do go up, the annual increase is typically much less than the amount you can recover by filing these claims. In the calculus, it will depend on whether your medical bills are high enough to make filing a claim advantageous.
